Lesson 30: Respect for Law

Respect for Law:



As the law of nature follows natural principles in the same manner the establishment of a society is dependent on social, moral, religious commandments. Even the person of a low caliber realizes the importance of following law and its necessity, but there are a few people who fulfill the demands of law. In the current age, people from their natural relations to international relations are avoiders of abiding law and this trend of lawlessness has spoiled the ace of the world.



It's a big question that why people disobey law despite of believing its significance.



 



i. The reasons of disobeying law:



There are two main reasons.



(i) Selfishness and opportunism



(ii) Thinking oneself above law.



 



ii. Islam and Respect of law:



Islam by eliminating the above mentioned reasons makes Muslims law abiding people and instills in them the realization of the life hereafter and they will not be saved from Allah's wrath due to breaking law. This realization urges them to go to court and get penalty here to avoid the punishment in the life after death.



iii. Law of equality in Islam:



It's important that rulers follow law to instill the spirit of abiding law among people and don't use their influence to avoid law.



It is popular that all are equal in front of law but there many not be any law and constitution where there are not special discounts given to rulers. It is famous incident of Islamic history that once the armor of Hazrat Ali was lost and it was found in the custody of a Jew. He took the Jew to court and on presenting his son and slave on witnesses the court refused to accept his claim, and he got dismissed from his claim. This incident of law abiding made that Jew so impressed that he became Muslim after reciting kalimah.



iv. Respect of law in light of Quran:



The laws which Allah J has revealed, He has directed to follow them and make decisions according to them. Allah says.





 



فاحكم بين كُم بِمَا اَنْزَلَ اللهُ ( المان ه: 48)



Translation: So judge between them by what Allah has revealed.



 



تلكَ حُدُودُ اللهِ فَلَا تَعْتَدُوهَا ( البقرة :229)



Translation: These are the limits of Allah, so do not transgress them.



 



. وَمَنْ لَمْ يَحْكُم بِمَا أَنزَلَ اللهُ فَأُولَيكَ هُمُ الظَّلِمُونَ (سال 45)



Translation: And whoever does not judge by what Allah has revealed then it is those who are the wrong doers.



v. Respect of law and Prophet's Pattern:



We get the best. lesson in Prophet's model for abiding law. He always obeyed Allah's commandments and implemented them in society.



vi. Dispute between a Jew and a Muslim:



Once a Jew and a Muslim had a dispute, they came to the Holy Prophet for final decision. He listened them and decided in favor of the Jew as he was right in that matter. The Holy Prophet didn't give decision on the basis of who belonged to which religion but decided according to the justice.



vii. Kasb-e-Halal - means Legal Earning:



It means to earn livelihood according to the ways described by Allah and His Prophet, such livelihood in which there is no effort and hard work is not allowed. Legal earning in the light of Holy Quran:



About Kasb-e-Halal, it is saying of Allah



 



ياتها الرُّسُلُ كُلُوا مِنَ الطَّيِّبَتِ وَاعْمَلُوا صَالِحًا المومنون : 51)



Translation: O messengers eat from the good food and work righteousness. In this way, all human beings have been directed:



 



يَاتِهَا النَّاسُ كُلُوا مِهَا فِي الْأَرْضِ حَللا طيبا ( القرة: 168)



 



Translation: O Mankind, eat from whatever is on earth (that is) lawful and good. Muslims have been advised particularly.



 



يَاتِهَا الَّذِينَ آمَنُوا كُلُوا مِنْ طَيِّبَتِ مَا رَزَقْنَكُمْ (البقره: 172)



Translation: O you, who have believed, eat from the good things which we have provided for you.



"Kasb-e-Halal" has utmost significance in the concern of worship and dealings. Therefore, for acceptance of worship, "kasb-e-halal" has been made mandatory. It is said by Allah



 



ولا تأكلوا امْوَالَكُمْ بَيْنَكُمْ بِالبَاطِلِ (البقر (188)



Translation: And do not consume one another's wealth unjustly.



viii. "Kasb-e-Halal" in light of hadees:



In ahadees, "kasb-e-halal" and purified sustenance have been emphasized.



Allah's Prophet said.



"The person who eats haram, his prayer is not accepted.



الْكَاسِبُ حَبِيبُ الله.



"The labourer is the friends of Allah".



 



طلبُ الْحَلَالِ فَرِيضَةٌ بَعْدَ الْفَرِيضَةِ



To earn halal (Legal) livelihood is an obligation after important obligations.



ما أكل أَحَدٌ طَعَامًا قَطُّ، خَيْرًا مِنْ أَنْ يَأْكُلَ مِنْ عَمَلِ يَدِهِ وَإِنَّ نَبِيَّ اللَّهِ دَاوُدَ عَلَيْهِ السَّلَامُ كَانَ يَأْكُلُ مِنْ عَمَلِ يَدِهِ -



Translation: The best sustenance is that which is earned through one's own hands Prophet, Dawood used to earn through his hands and (then) and Allah's eat.



 



ix. The sources of haram livelihood:



According to Islam the sources of haram livelihood are following.





  • Interest




  • Storing provision




  • Cheating in weighing goods




  • Devalue goods for more interest




  • Gambling




  • Adulteration




  • Theft




  • Robbery




  • Bribery




  • Smuggling and dealing in drugs




  • Earning through trade of wine and Other haram (illegal) goods
